Can a Worker who is injured in a Motor Vehicle Accident, claim on both Workers Compensation and Compulsory Third Party Insurance?
Where liability exists under CTP Insurance as well as workers compensation, then there is an entitlement to claim under both, however, you cannot retain both benefits. The workers compensation insurer will generally be reimbursed by the CTP Insurer prior to payment to the injured party.
What is the difference between a "Recurrence" and an "Aggravation" of an injury?
A "recurrence" is when the symptoms of a previous injury recur spontaneously without any external cause. This would result in the "old" claim being reopened. An "aggravation" is when symptoms of a pre-existing injury are increased by a new and definable event.
What should an employer do if they receive a Summons, Subpoena, Application for Arbitration or Statement of Claim?
The documents should be forwarded to the Insurer as soon as possible. With summons’ and subpoena’s, either produce the documents and forward a copy to Vero Workers Compensation or if in doubt, forward these to the solicitors acting on your behalf.
